1. What Information Do We Collect?

Personal information you disclose to us

In short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide when you express an interest in our Services, participate in activities on the Services, or contact us.

Personal Information Provided by You

The personal information we collect depends on the context of your interactions and the features you use. It may include:

  • Names

  • Email addresses

  • Contact preferences

Sensitive Information

We do not process sensitive information.

All personal information you provide must be true, complete, and accurate. Please notify us of any changes.

Information automatically collected

In short: Some information — such as your IP address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact details) but may include device and usage information, such as IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This helps maintain security and operations, and informs internal analytics and reporting.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:

  • Log and Usage Data: service-related, diagnostic, usage, and performance information (e.g., IP address, device info, browser type, settings, activity timestamps, pages and files viewed, searches, features used, device events, error reports).

  • Device Data: details about the device you use to access the Services (e.g., IP, device/app IDs, location, browser type, hardware model, ISP/mobile carrier, OS, system configuration).

  • Location Data: information about your device’s location, which can be precise or imprecise (e.g., approximate location based on IP). You can opt out by disabling location permissions, though some features may not function as intended.

Google API

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

2. How Do We Process Your Information?

In short: We use your information to provide, improve, and administer our Services, to communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve issues you might have with the requested service.

  • To save or protect an individual’s vital interests. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

3. What Legal Bases Do We Rely On to Process Your Personal Information?

In short: We only process your personal information when we believe it is necessary and we have a valid legal basis under applicable law (e.g., your consent, to comply with laws, to fulfil a contract, to protect your rights, or to pursue legitimate interests).

If you are located in the EU or UK, this section applies to you.

The GDPR and UK GDPR require us to explain the valid legal bases we rely on to process your personal information. We may rely on:

  • Consent: when you have given permission for a specific purpose. You can withdraw consent at any time (see Your privacy rights).

  • Performance of a Contract: when necessary to fulfil our contractual obligations, including providing our Services or taking steps at your request before entering into a contract.

  • Legal Obligations: when necessary to comply with the law (e.g., cooperating with authorities, exercising/defending legal rights).

  • Vital Interests: when necessary to protect your vital interests or those of a third party.

  • Legitimate Interests: when necessary for our business purposes and not overridden by your rights (e.g., communicating with clients, maintaining network security, improving services).

Controller versus processor

In legal terms, we are generally the data controller of the personal information described in this Privacy Notice, since we determine the means and/or purposes of the processing. This Privacy Notice does not apply to personal information we process as a data processor on behalf of our customers, where the customer is the data controller under our data processing agreement.

4. When and With Whom Do We Share Your Personal Information?

In short: We may share information in specific situations and with specific third parties.

We may need to share your personal information in the following situations:

  • Business Transfers: in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We do not sell or rent your personal information.

5. Do We Use Cookies and Other Tracking Technologies?

In short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar technologies (like web beacons and pixels) to gather information when you interact with our Services. Some tracking technologies help maintain security, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We may also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to manage and display ads, tailor ads to your interests, or send reminders (depending on your communication preferences). Third parties may provide advertising about products and services tailored to your interests, which may appear on our Services or on other websites.

To the extent these technologies are deemed to be a “sale”/“sharing” (which includes targeted advertising under certain US state laws), you can opt out as described below under Do United States residents have specific privacy rights?

Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.

Google Analytics

We may share your information with Google Analytics to track and analyse use of the Services. To opt out, visit: https://tools.google.com/dlpage/gaoptout. For more on Google’s privacy practices, visit Google’s Privacy & Terms pages.

6. How Long Do We Keep Your Information?

In short: We keep your information for as long as necessary to fulfil the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep personal information for as long as needed for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will delete or anonymise it, or, if deletion is not possible (for example, data stored in backups), we will securely store it and isolate it from further processing until deletion is possible.

7. How Do We Keep Your Information Safe?

In short: We use technical and organisational security measures to protect your personal information.

We have implemented appropriate and reasonable security measures designed to protect the information we process. However, despite our safeguards and efforts, no electronic transmission or storage can be guaranteed 100% secure. Although we will do our best to protect your personal information, transmission to and from our Services is at your own risk. You should only access the Services within a secure environment.

8. Do We Collect Information From Minors?

In short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18, or are the parent/guardian and consent to a minor’s use. If we learn that personal information from users under 18 has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. If you become aware of any data we may have collected from children under 18, please contact us at dpo@newgenre.studio.

9. What Are Your Privacy Rights?

In short: Depending on your state of residence in the US or in some regions, such as the EEA, UK, and Switzerland, you may have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

  • Request access and obtain a copy of your personal information

  • Request rectification or erasure

  • Restrict processing

  • Data portability (if applicable)

  • Not be subject to automated decision-making

If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

Withdrawing your consent

If we rely on your consent, you can withdraw it at any time by contacting us (see How can you contact us). This won’t affect processing carried out before withdrawal, and we may still rely on other lawful bases where applicable.

Opting out of marketing and promotional communications

You can unsubscribe at any time by clicking the unsubscribe link in our emails or contacting us. We may still send non-marketing communications (e.g., service messages).

Cookies and similar technologies

Most browsers accept cookies by default. You can remove or reject cookies in your browser settings. Doing so could affect certain features of our Services.

If you have questions about your privacy rights, email us at hello@newgenre.studio.

10. Controls for Do-Not-Track Features

Most web browsers and some mobile OS/apps include a Do-Not-Track (“DNT”) setting to signal your preference not to be tracked. There is currently no uniform standard for recognising DNT signals, so we do not respond to them. If a standard is adopted that we must follow, we will update this notice.

California law requires us to disclose how we respond to DNT signals. Because there is no industry or legal standard, we do not respond at this time.

11. Do United States Residents Have Specific Privacy Rights?
